RESALE RIGHT DIRECTIVE
To remove the distortions affecting the contemporary and
modern art market and to abolish the discrimination suffered
by artists depending on the prevailing legal situation in
the country in which their works are sold, the Commission
put forward a proposal for a directive in June 1996 aimed
at introducing the resale right throughout the European
Union and harmonising some of its rules of implementation.
A Directive (2001/84/EC) was finally adopted in September
2001, but was based on rather unfair compromises that were
absolutely unprecedented in the field of copyright.
